Why should I create a Will?
In truth, your Will makes administering your estate less complex for your loved ones, and ensures your gifts pass to your chosen beneficiaries, not those chosen for you.
How long does it take?
The process takes as long as you wish it to take. I act at a pace you are comfortable with; you are always in control.
What do I need?
There are three things you need to know to make a Will, the extent of your estate [your worldly goods], who is entitled to it and to whom you wish to gift it. I act to assist and support your decision making to turn your wishes in to a legally binding document, which comes as a great relief to many of my clients.
Is it complicated?
Your Will can be as detailed or as simple as you wish. You may wish to have simple single or mirror (you and your partner) Wills or more complex Wills which give instructions to protect assets in post-death trusts.
What if I do not have a valid Will?
Without a Will, your estate will be subject to the ‘Laws of Intestacy.’ The first portion of your estate will go to the surviving spouse or civil partner, with the remainder divided between the survivor and the children. It is not uncommon for whole families to lose inheritances because of remarriage, or the survivors need for long term care. If you are unmarried, your partner will receive nothing. Do not leave your estate in the hands of others, who you may not wish to inherit and/or who are not legally bound to execute your wishes.
What does it cost?
I work on a fixed fee basis, agreed in advance, so there are no hidden costs. I offer discount for NHS staff, so please do not hesitate to ask for a quote.
Powers of Attorney
It is a common misconception that family members can act for one another, this is not the case. The reason is to protect loved ones from exploitation. If you are over eighteen and have mental capacity, you can create Lasting Powers of Attorney (LPAs) and appoint attorneys (usually loved ones) to assist you to make decisions and/or act for you. Please ask me for more information.
